Terms of Service

These terms govern the use of the HoReCaWave service (the "Service") by hospitality businesses (the "Customer"). The provider is FinRev Solutions S.L. (in formation), Málaga, Spain (the "Provider").

1. Subject matter

The Provider operates a SaaS platform that combines weather, cruise, flight, event and seasonality data into daily forecasts and multilingual briefings per location. The scope of delivery follows the plan description on the website at the time of signup.

2. Conclusion of contract

The contract takes effect upon self-service account creation or upon acceptance of a written order. By creating an account the Customer agrees to these terms in the version current at that moment.

3. Pilot phase

New customers get a 60-day free pilot starting at account creation. There are no fees during the pilot and the Customer can stop using the Service at any time without providing reasons.

4. Fees and invoicing

After the pilot ends, the selected plan becomes payable. Billing is monthly via invoice; SEPA direct debit is available. Prices are exclusive of statutory VAT.

5. Term and termination

The contract runs for an indefinite term and can be terminated by either party at the end of the calendar month with 14 days notice. Notice is given in text form to support@horecawave.com.

6. Availability

The Provider targets 99% monthly availability but owes no specific SLA during the pilot phase. Maintenance windows are announced when possible.

7. Liability

Forecasts are decision suggestions, not guarantees. The Provider is liable only for damages caused by intent or gross negligence and as required by mandatory law. Liability for lost profits or consequential damages from staffing or purchasing decisions is excluded to the extent permitted by law.

8. Data protection

The Provider only processes aggregated daily data and venue master data. No guest or staff data is processed. Data processing under GDPR Art. 28 is the default; see the Privacy Policy for details.

9. Changes

The Provider may change these terms with 30 days notice. If the Customer does not object within that period, the amended terms apply.

10. Governing law and jurisdiction

Spanish law applies, excluding the UN Sales Convention. Place of jurisdiction is Málaga, Spain.
